Arizona AG fears federal RealPage lawsuit may be dropped under Trump
PHOENIX (AZFamily) — Arizona Attorney General Kris Mayes said on Wednesday that she is worried the federal RealPage lawsuit could be on the chopping block after President Donald Trump rolled back lots of work done under the Biden administration.
“I am concerned about that. In fact, we are actually considering sending a letter to (U.S. Attorney General) Pam Bondi to encourage her to not drop that case,” said Mayes.
Last February, Mayes sued the software company and nine major apartment landlords over an alleged rent-raising conspiracy that hurts hundreds of thousands of people in Arizona.
“Old-fashioned collusion using new technology,” she said.
Lupe Conchas is a housing advocate with the Fuerte Arts Movement.
“I know for me personally I had a 14% increase in 2023,” said Conchas.
The nonprofit is involved with the Mayes’ case and is spearheading a “Rent is too High” campaign.
“We are just trying to keep the big corporate landlords accountable. These corporations are basically using our real estate market in order to line the pockets of their investors,” said Conchas. “We believe that housing is a human right.”
In August, the DOJ, alongside Attorneys General in eight other states, filed a similar lawsuit against RealPage, accusing it of monopolizing the market through an algorithmic pricing scheme. The complaint claims that RealPage uses technology to coordinate rent prices among the big apartment companies.
“We need competition again and that’s what I think is so insidious about this situation with RealPage is, it was eliminating competition,” said Mayes.
Mayes said even if the federal suit is dismissed, she hopes other states will continue to fight for fairness.
“We filed our lawsuit here in Arizona state court so regardless of what happens with the DOJ, our case will continue and we’ll be able to protect Arizonans,” said Mayes.
“We want justice,” said Conchas.
Arizona’s Family reached out to the Justice Department to ask about the latest on the RealPage lawsuit, and we did not hear back on if the agency plans to throw out the case.
